Terms of Service

These Terms of Service ("Terms") govern your access to and use of Tour Reels, a social media automation platform for tour and activity businesses, operated by Moonshine Media Group LLC ("we," "us," or "our"). By creating an account or using Tour Reels, you agree to these Terms.

1. The Service

Tour Reels is a subscription software platform that helps tour and activity operators automate their social media content. The service includes:

• An AI agent ("Reel") that receives photos from your staff via SMS
• AI-generated caption and hashtag suggestions
• An approval queue for reviewing and scheduling posts
• Automated publishing to connected Instagram and Facebook accounts
• Integration with Peek Pro to sync tour schedules and trigger shot briefs
• Team management and analytics tools

2. Account Registration

You must provide accurate business information when creating an account. You are responsible for maintaining the security of your account credentials. You may not share your login credentials or allow multiple businesses to use a single account.

You must be at least 18 years old and authorized to enter into contracts on behalf of your business to use Tour Reels.

3. Subscription and Payment

Tour Reels operates on a monthly subscription basis. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.

• Subscriptions auto-renew each month unless cancelled
• You may cancel at any time; access continues through the end of the current billing period
• We do not offer prorated refunds for partial months
• We reserve the right to change pricing with 30 days' notice to active subscribers

4. Your Content and Responsibilities

You retain ownership of all photos, business content, and data you provide to Tour Reels. By using our service, you grant us a limited license to process, store, and publish your content on your behalf as directed by your account settings.

You are solely responsible for:

• Obtaining proper consent from guests and staff before their photos are used in social media posts
• Ensuring all published content complies with applicable laws, including privacy, publicity, and copyright laws
• Reviewing and approving AI-generated captions before they are published
• The accuracy of your business information, tour descriptions, and booking data
• Compliance with Meta's (Instagram/Facebook) Terms of Service and Community Standards
• Compliance with Twilio's Messaging Policy for business SMS use

5. Acceptable Use

You agree not to use Tour Reels to:

• Publish content that violates any law or third-party rights
• Post content that is false, misleading, defamatory, or deceptive
• Publish photos of identifiable minors without documented parental consent
• Spam, harass, or send unsolicited messages to staff or guests
• Attempt to circumvent platform security or rate limits
• Use the service for any purpose other than legitimate social media marketing for your tour or activity business

We reserve the right to suspend or terminate accounts that violate these guidelines.

6. Social Platform Compliance

Tour Reels publishes content to Instagram and Facebook via the Instagram Graph API, subject to Meta's platform policies. You understand that:

• Your connected Instagram account must be a Business or Creator account
• Meta may change its API terms, which may affect service functionality
• Tour Reels is not affiliated with or endorsed by Meta
• Your use of social platform features through Tour Reels is also governed by Meta's Terms of Service

7. AI-Generated Content

Captions and content suggestions are generated by AI and may occasionally contain errors, inaccuracies, or inappropriate content. You are responsible for reviewing all AI-generated content before publishing. Tour Reels does not guarantee the accuracy, quality, or suitability of AI outputs. We recommend always reviewing captions in your approval queue before approving posts.

8. Integrations and Third-Party Services

Tour Reels integrates with third-party platforms including Peek Pro, Twilio, Instagram, and others. We are not responsible for the availability, accuracy, or terms of third-party services. Disruptions to third-party APIs may affect Tour Reels functionality. We will make reasonable efforts to maintain integrations but cannot guarantee uninterrupted third-party connectivity.

9. Intellectual Property

The Tour Reels platform, software, design, and branding are owned by Moonshine Media Group LLC. You may not copy, reproduce, distribute, or create derivative works from our platform without written permission.

AI-generated captions produced by Tour Reels on your behalf are provided to you for your use. We make no copyright claims over AI-generated content produced from your inputs.

10. Disclaimers and Limitation of Liability

Tour Reels is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that posts will publish successfully at all times (social platform outages, API limits, and account issues are outside our control).

To the maximum extent permitted by law, Moonshine Media Group LLC's total liability for any claims arising out of or related to Tour Reels shall not exceed the fees you paid in the three months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

11. Indemnification

You agree to indemnify and hold harmless Moonshine Media Group LLC and its officers, employees, and agents from any claims, damages, or expenses (including attorney's fees) arising from your use of Tour Reels, your content, your violation of these Terms, or your violation of any third-party rights.

12. Termination

You may cancel your subscription at any time through your account settings or by contacting us. We reserve the right to suspend or terminate your account for violation of these Terms, non-payment, or misuse of the platform, with or without notice depending on the severity of the violation.

Upon termination, we will retain your data for 30 days to allow for account recovery, after which it may be permanently deleted.

13. Changes to Terms

We may update these Terms from time to time. We will notify active subscribers of material changes via email at least 14 days before they take effect. Continued use of Tour Reels after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Florida.
